Selling a Gold Coast home with a pool? Certify before you list
Selling a house with a pool in QLD? Here's when you need a pool safety certificate or Form 36, and how to get certified on the Gold Coast before you list.
Selling a house with a pool in QLD? You need a current pool safety certificate (Form 23) before settlement. The alternative is a notice of no pool safety certificate (Form 36), given to the buyer before the contract is signed. The simplest path is to certify before you list. Rob is usually able to inspect within 24 hours, and compliant pools get their certificate the same day.
Do I need a pool safety certificate to sell a house in QLD?
Yes, or a Form 36 in its place. If your property has a current certificate, you give the buyer a copy before settlement. If it does not, you give the buyer a Form 36 before the contract is signed. You also lodge the Form 36 with the QBCC before settlement. Those are the only two paths to a sale.
A certificate lasts 2 years for a non-shared pool, like a house or townhouse. It lasts 1 year for a shared pool. You can check whether yours is still current on the QBCC pool register. The full seller rules are on the QBCC page for buying, selling or leasing a property with a pool.
When should I book the pool inspection?
Book it before your listing date. Gold Coast homes can sell quickly, and a short settlement leaves little room for fence work. Inspecting early means any fault is found and fixed on your timeline. Rob is usually able to inspect within 24 hours of your call, and a compliant pool gets its certificate the same day.
Get a head start with our pool safety checklist. It covers the points that come up most often, so you can sort the easy ones before Rob arrives.
Can I check my pool before the inspection?
Yes. Book a pool safety consultation. It costs from $100 + GST. Rob walks the barrier with you and tells you exactly what to fix. When the pool is ready, you book the inspection and get certified.
What happens if my pool fails the inspection?
You get a non-conformity notice (Form 26). It lists each fault and the fix that will pass. You then have 3 months to get the same inspector back for the re-inspection, from $79 + GST. Rob spent 20 years building pool fences, so he does minor repairs himself and quotes anything bigger upfront.
Often the fix is small. A gate that no longer self-closes. A latch that needs adjusting. A pot plant sitting inside the 900mm non-climbable zone. Rob shows you each one, with photos, in a clear report.
Can I sell with a Form 36 instead of a certificate?
Yes. A Form 36 lets the sale go ahead without a certificate. For a non-shared pool, the buyer then has 90 days after settlement to get one. For a shared pool, the body corporate gets it. A Form 36 is not an exemption, though. Your barrier must still meet the pool safety standard until settlement.
A buyer who sees a Form 36 knows there may be work ahead. They can book a pre-purchase pool inspection and bring the repair cost to the negotiation. A certificate in hand takes that question off the table.
What if I’m selling at auction?
The same rules apply. If there is no current certificate, you or your agent must give every prospective buyer a copy of the Form 36 before a contract is signed. That includes the auctioneer. With a certificate already in hand, there is nothing extra to hand out on auction day, and bidders see a pool that is ready to go.
What does a pre-sale pool inspection cost?
A pool safety inspection is from $100 + GST per pool. The QBCC certificate fee (Form 23) is $47.30, with no GST. A re-inspection, only if needed, is from $79 + GST. We register your pool with the QBCC at no extra cost. Your exact price is confirmed when you book. See the full pool inspection pricing.
