Renting a Gold Coast property with a pool? Here's how QLD pool laws work
Every QLD rental with a pool needs a pool safety certificate before the lease is signed. Here's what landlords, tenants and property managers need to do.
Every rental property with a pool in QLD needs a current pool safety certificate before the lease is signed. The landlord gets it. The tenant keeps the pool area secure day to day. The property manager keeps both sides on track. Here is how each role works, and how Rob gets your rental certified on time.
Does a rental property need a pool safety certificate in QLD?
Yes. For a house or townhouse with a non-shared pool, the owner must not enter a lease unless a pool safety certificate is in effect. That certificate lasts 2 years. For a unit with a shared pool, the body corporate usually holds the certificate, and it lasts 1 year. A copy should come with the tenancy agreement.
The rules are set out by the QBCC on its page for buying, selling or leasing a property with a pool. Shared pools must also display the current certificate near the main entrance or at the pool gate.
Who is responsible for the pool certificate: landlord or tenant?
The landlord. The property owner must keep the pool barrier compliant at all times and hold a current certificate for each new lease. A property manager can book the inspection on the owner’s behalf. The tenant never arranges the certificate, but does share the day-to-day job of keeping the pool area secure.
What are a tenant’s pool safety responsibilities?
Tenants keep pool gates shut and never prop them open. They keep pots, chairs and toys away from the fence, so nothing helps a child climb over. They tell the landlord or property manager straight away if a gate stops self-closing or the fence is damaged. Everyday upkeep, like cleaning, is set in the tenancy agreement.
The Residential Tenancies Authority covers the detail in its guide to pool laws and maintenance. Tenants also use the entry condition report (Form 1a) to confirm they received a copy of the certificate and to note the pool’s condition.
What should property managers check at each lease?
Check the certificate’s expiry date before every new lease and every renewal. Confirm the pool is on the QBCC pool register. Give the tenant a copy of the certificate with the tenancy agreement. Then book the next inspection a few weeks before expiry, so there is time for any fix and the certificate never lapses between tenants.
Property managers can send us the address and the owner’s details. We book the inspection, keep everyone updated, and send the certificate to you both.
What happens if the pool fails its inspection?
The owner gets a non-conformity notice (Form 26). It lists each fault and how to fix it. The same inspector must re-inspect within 3 months. Rob does minor repairs himself, like latches and hinges, and quotes anything bigger upfront. A re-inspection is from $79 + GST, and only if one is needed.
If the pool cannot be used while it is being fixed, the RTA says the tenant may be able to negotiate a rent reduction until it is resolved.
Do portable pools and spas at a rental need a certificate?
Yes, when they are big enough. The RTA lists three triggers: water deeper than 300mm, a volume over 2,000 litres, or a filtration system. Tenants need the owner’s permission before setting one up. A tenant who installs a portable pool or spa is responsible for making it compliant, including the barrier.
How much does a rental pool inspection cost?
A pool safety inspection is from $100 + GST per pool. The QBCC certificate fee (Form 23) is $47.30, with no GST. We register the pool with the QBCC at no extra cost. Your exact price is confirmed when you book. See our full pool inspection pricing for every service.
