Certificates
You need a current pool safety certificate (Form 23) before you sell or lease a Queensland property with a pool or spa. A QBCC licensed pool safety inspector issues it once the pool passes a full inspection. On the Gold Coast, Rob inspects and certifies house pools and shared pools at complexes.
Buying, selling & leasing
Yes. You give the buyer a notice of no pool safety certificate (Form 36) before the contract is signed. The buyer then has 90 days after settlement to get a certificate. The pool must still be compliant in the meantime. Many sellers certify before listing, so the pool stays out of the negotiation.
Rules & compliance
Yes. Queensland pool safety laws apply to any pool or spa that can hold 300mm of water or more. That includes spas, swim spas, inflatable pools and portable pools. They must meet the same pool safety standard as an in-ground pool, and they must be registered with the QBCC.
